Segkind Limited TERMS
& CONDITIONS
1. All Segway riders must be over 45 kilos and
under 117kilos in weight
2. Any customers suspected of being under the
influence of alcohol or recreational drugs will
not be permitted to use Segkind’s services
and will forfeit their full booking fee.
3. Confirmation for rallies will be sent by
email.
4. Customers who have
purchased gift vouchers must make sure that
the voucher/s are in Segkind’s possession
no later than 5 days before their Rally is due
to take place (address details will be provided
with confirmation email). If a voucher is due to pass its expiry date customers must make sure that the voucher is in Segkind's possession before the expiry date marked on the voucher (unless written confirmation of an extension has been issued by a voucher vendor)
5. Riders must
have the ability to make motions such as climbing
and descending stairs without assistance.
6. Pregnant women cannot be permitted to participate
for safety reasons.
7. Customers MUST inform Segkind staff of any
disability or injury prior to taking part in
a Segway Rally experience or any other Segway
riding activity.
8. Any individual hiring a Segway is not permitted
to sub-contract or re-hire all or part of Segkind’s
facilities.
9. A deposit of £250.00 is taken by Segkind
from ALL Segway hire customers (this does not apply to SegRally experience customers). Deposits can
be accepted from debit or major credit cards.
The deposit may be retained by Segkind from
the customer if Segkind's Segway/s has been
damaged or has developed a fault which may have
developed from improper use of the Segway/s
by the customer and/or if the Segway is not
returned or picked up by Segkind from the customer
in the condition that it was delivered. The
customer will be charged costs for any repairs
necessary due to the aforementioned circumstances.
10. Full payment is required at the time of
booking for most services.
11. No refund will be paid on ANY booking cancelled
within 28 days of the event date.
12. Bookings cancelled prior to 28 days of the
event date incur 50% of the service cost as
a cancellation penalty.
13. No refund
will be paid on ANY booking where the client
fails to arrive for ANY reason.
14. Any client that fails
to arrive or cancels their booking within 28
days of the event date will not be offered a
new date to take part.
15. Bookings are subject to customers supplying
requisite contact details.
16. All riders are required to wear helmets
and any other safety gear which has been supplied
by Segkind.
17. Segkind reserves the right to refuse or
withdraw its services without any reason or
compensation.
18. Abusive behaviour or language or any threats made to anyone under the employment of Segkind Limited will not be tolerated and will result in a prosecution and any purchase made for any service will be cancelled without a refund.
19. Segkind reserves the
right to alter the format of its services without
any reason or compensation.
20. Segkind reserves the right to include additional
hourly charges of not less than £50.00
+ VAT for any late return of Segways hired or
for any events which exceed the agreed duration.
21. Segkind reserves the right to alter or change
these terms and conditions at any time without
prior notice.
22. These terms and conditions
apply to any Segkind customer or apporved agents
bound by agreement or contract.
23. Failure to comply with any of Segkind's terms
and conditions, rules or instructions may effect
the ability of any customer to claim on our
public liability insurance.
24. Losses amounting to
the replacement value of any Segway or other
machinary hired by fault of the customer will
be charged to the said customer.
25. Segways not in use
whilst on hire by a customer must be stored
in a locked environment with infokey/s removed
– You may be charged the full amount of
our insurance excess costs and for any loss
of business if we need to claim for any loss
of our property that you have hired.
26. All SegRally Segway Rally Experience customers must sign our disclaimer before participation. By signing this disclaimer all customer's or individuals making use of any of SegKind's services agree to indemnify SegKind and its directors, officers, employees and third party agents from and against loss, claims, liabilities, damages, expenses, direct, indirect or consequential, incurred by any customer or individual arising from any negligence or wrongful act or omission by the individuals or the customer's directors, officers, employees, sub-contractors, agents or representatives.
27. Segkind may on occasion by required to cancel Segway events or Segrally Segway Rally Experience sessions due to adverse weather conditions which may compromise the safety of customers or from situations out of the control of SegKind. If SegKind cancels any events or Segway experiences notice will be given as soon as possible. SegKind will not pay customers any compensation or refund but will endeavour to provide the same service offered as soon as possible.
28. Force Majeure
Segkind shall not be deemed to be in breach of any duty, agreement or contract or otherwise be liable to any customers or individuals by reason of any delay or failure in the performance or its obligations under any duty, agreement or contract to the extent that such delay or failure is caused by force majeure of which it has notified customers or individuals and the time for performance of the relevant obligation shall be extended accordingly.
Force Majeure shall include acts of God, acts of Government, fires, floods, epidemics, freight embargoes, civil commotion, labour disputes, terrorism or any cause which is reasonably beyond the control of Segkind. If the Force Majeure in question prevails for a continuous period in excess of three months then Segkind shall enter into bona fide discussions with a view to alleviating its effects or to agreeing upon such alternative arrangements as may be fair and reasonable.
